Finances in divorce proceedings

Since The Divorce, Dissolution and Separation Bill completed its passage through the House of Commons in June 2020 changes came into force into force in April 2022, which have simplified the procedure for obtaining a divorce.
The changes have made it much easier for couples to file their own divorce petitions online which is a good thing as it can save on legal fees, although we appreciate that many people still like their solicitor to file their divorce petition and we are happy to do this. As a result of the changes, divorcing couples may well ask “if divorce is going to be made easier, do I really need a divorce lawyer?” The answer is “Yes you probably do”.
Dealing with your finances as part of a divorce can be complicated. Even couples who are able to negotiate a financial agreement between themselves would be foolish not to have the agreement recorded in a legally binding order of the court. A divorce alone allows you to remarry but does not end financial claims that an ex-spouse may be able to make against the other in the future. A consent order provides certainty and peace of mind.
