Data Protection Enforcement Notice

Under Section 40 of the Data Protection Act 1998, the Information Commissioners Office has the power to issue an Enforcement Notice upon a Data Controller if it considers that the Data Controller has contravened or is contravening any of the Data Protection Act principles.


An Enforcement Notice can ask the Data Controller to carry out appropriate steps to comply with the principles within a certain time. Such an Enforcement Notice was served upon Medway Council this summer.


Apparently the council had been warned on a number of occasions that they needed to improve their Data Protection training for staff and this was not done to the satisfaction of the Information Commissioners Office and thus an Enforcement Notice was served requesting them to comply.
