We're proud to announce that David Denovan-Smith from SME Solicitors is duly registered as a member of the Association of Contentious Trust and Probate Specialists.

David Denovan-Smith has recently been accepted as a member of the Association of Contentious Trusts and Probate Specialists (ACTAPS). 

ACTAPS was launched in September 1997 for lawyers specialising in trust and probate work. 

ACTAPS has a published Practice Guide called “the ACTAPS Code”, which is a voluntary code aimed to promote the resolution of trust and probate disputes without the need for what are often bitter and very expensive court proceedings.  It encourages careful use at an early stage of mediation processes and explaining to clients how best to manage the difficulty, so often present in these sorts of cases. 

The ACTAPS Code is not part of the Civil Procedure Rules (CPR) but its members hope is that judicial regard will be given to appropriate attempts to comply with the Code in the spirit of the CPR.

The Code is designed to make specific provision for particular aspects of trust and probate disputes which have been found in practice to call for special care.  Its members aim is to secure a quicker and more cost effective resolution to these types of disputes that are often bitter, personal and ultimately very expensive if they end being decided in court. 

 The professed aims of ACTAPS members are to encourage parties to a potential dispute to actively engage in alternative dispute resolution, without hostile litigation and where litigation proves necessary, to ensure that every effort is made to simplify it by maximising the scope for the exchange of relevant information before the commencement of proceedings.
